ACCMATRIX LICENSE AGREEMENT

DIAMETRIX SOLUTIONS CC INCORPORATING ACCMATRIX ACCOUNTING

(Hereinafter referred to as ACCMATRIX)

 

ACCMATRIX LICENSE AGREEMENT
 This is a legal agreement between you, the user, and ACCMATRIX. BY INSTALLING THE SOFTWARE ON A COMPUTER, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT.  IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, PROMPTLY RETURN THE PROGRAMS AND ACCOMPANYING ITEMS (including written material and binders and other containers) TO THE PLACE WHERE YOU OBTAINED THEM FOR A FULL REFUND.

ACCMATRIX SOFTWARE LICENSE
 GRANT OF LICENSE: ACCMATRIX grants users the right to use the program on a network system per computer installation. The "USERS" database sets up the Users logon access and the list of companies.
COPYRIGHT: The software is owned by ACCMATRIX and is protected by the International Copyright Laws and International Treaty Provisions.Therefore you must treat the SOFTWARE like any other copyrighted material (e.g. a book or musical recording) except that you may make copies of the SOFTWARE solely for backup or archival  purposes. You may transfer the SOFTWARE to a hard disk provided you keep the original  CD for license purposes or you may download the software from the Internet.
OTHER RESTRICTIONS: The software is sold and supplied to you for your exclusive use. You shall not lend, let or permit the use thereof, or sell or otherwise dispose thereof, to any person without the written permission of the developers or publishers.


ACCMATRIX LIMITED WARRANTY
 LIMITED WARRANTY: ACCMATRIX warrants that the SOFTWARE will perform in accordance with accompanying written materials for a limited period of 90 days from date of receipt. Any implied warranties on the SOFTWARE shall be limited to 90 days.
CUSTOMER REMEDIES: The entire liability of ACCMATRIX and it's suppliers shall be at ACCMATRIX's option, either (a) return of the price paid or (b) repair or replacement of the SOFTWARE that does not meet ACCMATRIX's Limited Warranty and which is returned to ACCMATRIX with a copy of your receipt. This Limited Warranty is void if the failure of the SOFTWARE has resulted from accident, abuse or misapplication.
NO OTHER WARRANTIES: ACCMATRIX AND IT'S SUPPLIERS DISCLAIM ALL  OTHER WARRANTIES, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SOFTWARE AND THE ACCOMPANYING WRITTEN MATERIAL. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL ACCMATRIX OR IT'S SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OR BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THIS PRODUCT EVEN IF ACCMATRIX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
